Paradigma Gift Card terms and conditions of use
TERMS AND CONDITIONS OF USE OF THE PARADIGMA GIFT CARD
1. Introduction
1.1 GIFT CARD PARADIGMA ("GIFT CARD") is a service provided by THISCLOSE - UNIPESSOAL LDA, NIPC 517401657, with registered offices at Rua Braamcamp, n.º 12, 3.º Esq., 1250-050 Lisboa ("THISCLOSE").
1.2 By purchasing or using a GIFT CARD, the customer acknowledges and accepts that the contract for supply, management and validity is established exclusively with THISCLOSE.
1.3 Paradigma acts only as an intermediary, providing the link between the end customer and THISCLOSE. By purchasing the GIFT CARD, the customer acknowledges and accepts that the contract for the supply of Gift Cards is established exclusively between the customer and THISCLOSE. Paradigma assumes no responsibility for issues related to the ordering, payment, delivery, return or use of the products purchased.
1.4. Paradigma limits its responsibility to the dissemination and promotion of GIFT CARDs on its channels. All matters relating to purchase, use and support are the sole responsibility of THISCLOSE.
2. Definitions
2.1 GIFT CARD: A gift voucher available in digital or physical format, usable in the establishments indicated.
2.2 BENEFICIARY: The person who uses the Gift Card to carry out a transaction.
2.3 ISSUER: Thisclose - Unipessoal Lda, responsible for issuing and managing the Gift Card.
2.4 CUSTOMER: The person who purchases the Gift Card, who may or may not be the beneficiary.
3. Availability
3.1. The GIFT CARD is available in predefined values: 50€, 100€, 150€, 200€, 250€, and 300€.
3.2 Other prices may be available from time to time and will be announced on the website at the time of purchase.
3.3 The purchase of the GIFT CARD is subject to the availability indicated on the website and the payment made by the customer.
4. Validity
4.1. The GIFT CARD is valid for 1 (one) year from the date of purchase, unless expressly stated otherwise at the time of purchase.
4.2. After the end of this period, the remaining balance on the GIFT CARD automatically expires and cannot be used or refunded.
4.3 The validity of the GIFT CARD cannot be extended, except by express decision of THISCLOSE.
4.4. The customer is responsible for checking the validity of the GIFT CARD before using it.
5. Utilization
5.1. The GIFT CARD is only valid in venues operated by Paradigma in Portugal, unless expressly stated otherwise.
5.2 The GIFT CARD is valid for a single transaction, unless otherwise stated at the time of purchase.
5.3 If the value of the transaction is less than the balance available on the Gift Card, the remaining balance will be automatically cancelled and cannot be used for future transactions.
5.4 If the amount of the transaction exceeds the balance available on the GIFT CARD, the beneficiary is responsible for paying the remaining amount at the time of purchase.
5.5. The GIFT CARD cannot be used to purchase other Gift Cards or products from the online store, unless expressly stated otherwise by THIS CLOSE.
6. Reservation and Prior Communication
6.1 The use of the GIFT CARD in any of Paradigma 's restaurants is subject to the availability of the selected restaurant.
6.2 The beneficiary is responsible for making the reservation at least 48 hours in advance and must inform, at the time of booking, of the intention to use GIFT CARD as a form of payment.
7. Delivery formats
7.1 Digital format: The GIFT CARD will be sent to the email address provided by the customer at the time of purchase, free of charge.
7.2 Physical format: Available at an additional cost, it will be sent by post to the address indicated at the time of purchase.
7.3 THIS CLOSE is not responsible for delays in delivery due to incorrect information provided by the customer or situations beyond its control, such as strikes or extreme weather conditions.
8. Loss, theft or damage
8.1. The GIFT CARD is equivalent to cash and must be treated with care, with the customer being responsible for its safekeeping.
8.2 THIS CLOSE is not responsible for lost, stolen or damaged GIFT CARDS, nor for any balance misused.
8.3 THIS CLOSE will not be held responsible for fraudulent or unauthorized use of the GIFT CARD.
8.4 In the event of loss or theft, the customer may contact THIS CLOSE with proof of purchase. Replacement will be assessed if the GIFT CARD has not yet been used and will be decided exclusively by THIS CLOSE.
9. Refunds and Transferability
9.1 The GIFT CARD is non-refundable and non-convertible into cash, unless required by applicable law.
9.2 The GIFTC ARD is transferable and can be used by third parties provided they have the unique code (serial number) associated with the GIFT CARD.
9.3 The use of the GIFT CARD by third parties does not exempt the original customer from the responsibilities set out in these Terms and Conditions.
10. Limitations of use
10.1 The GIFT CARD cannot be used in conjunction with other promotions, discounts or offers, unless expressly stated otherwise by THISCLOSE.
10.2 Products or services purchased with the GIFT CARD are subject to the general sales conditions applicable at the venues where it is used.
10.3 The GIFT CARD may not be used for split payments on different occasions and is for single use only, unless expressly stated otherwise.
11. Returns Policy
11.1 The GIFT CARD is non-refundable once issued, unless required by applicable law.
11.2 If the customer identifies an error on the GIFT CARD (e.g. incorrect value or shipment to the wrong address), they must report it to THISCLOSE within 5 (five) working days of purchase. THISCLOSE will assess the situation and may correct the error, as long as the GIFT CARD has not yet been used.
11.3 Returns are not accepted for GIFT CARDS purchased during promotional campaigns or with discounts applied.
11.4 In the event of a technical defect or proven error in issuance by THISCLOSE, the customer will be entitled to a new GIFT CARD with the correct value, as long as the original balance remains intact.
11.5 The Client may not request the return or refund of balances remaining on the GIFTC ARD after its expiration date.
12. Changes to the Terms and Conditions
12.1 THISCLOSE reserves the right to change these Terms and Conditions at any time, with immediate effect after publication on the website.
12.2 Amendments to the Terms and Conditions apply only to GIFT CARDS purchased after the date on which such amendments come into force.
12.3 It is recommended that customers regularly consult the Terms and Conditions to stay informed of any changes.
13. Applicable Law and Conflict Resolution
13.1 These Terms and Conditions are governed by Portuguese law.
13.2 Any dispute arising from the purchase, use or management of the GIFT CARD shall be settled in the courts of the District of Lisbon, waiving any other jurisdiction, unless otherwise provided by law.
